Dear Seniors,

I have issued a showcase notice to employees for absenteeism, but even after 48 hours, they have not replied. I called and asked them, but they still have not responded. Please suggest to me what the next step should be, and kindly send me the format as well.

Thank you.

(Fact Checked)-The next step should be a domestic inquiry after issuing a second notice. Ensure compliance with labor laws and company policies. (1 Acknowledge point)

    MY SUGGESTION:
Please issue a Notice of Enquiry stating therein that they have not replied to the SCN as required in the notice and despite oral reminders about the non-submission of an explanation.

The Enquiry Notice must also contain the details of the Name of E.O., Date, time, and place of the enquiry. Please include that they would be permitted to have one of their co-workers of their choice and that no outsider will be permitted (please state the clause of CSO/MSO). Please also state that the enquiry will be conducted in a fair and transparent manner adhering to the principles of natural justice.

  • Normally, a Show Cause Notice (SCN) contains the incidence and seeks clarification or a show cause as to why disciplinary action should not be taken against the employee.

In case the employee fails to submit a reply to the SCN, you can proceed further to issue a charge sheet and conduct an enquiry.

(Fact Check Failed/Partial)-The user's reply is partially correct. In addition to the details mentioned, the reply should also state the consequences of not responding to a show cause notice, which could lead to adverse actions. It is crucial to follow due process.
