I was working in one company at wada since from 5yrs.and now owner forced me to resign, and in resignation letter i wrote about the same but he tolled me not to write this all only resignation. BUT I refused although he accept it and relived by sending the e mail to me. This all happen on 3rd of this month. So after diwali i started to work on it.WHERE I SHOULD GO TO LABOUR COURT OR ANY OTHER PLACE?

1. What were the circumstances under which you were asked to resign.
2. In what capacity you were working in the organisation.
3. What is the status of your final settlement.

Thanks men for you concern about the member's request. I would like to disagree with some of the comments given across. My view is that a problem is a problem and needs to be handled professionally regardless of how it is framed. Desperate situations need desperate solutions/ measures. My question to the questionnaire is that , is he/ she a member of any professional body in the country he/she is writing from. Did he/she ever tried seeking their professional advise before coming on this site? What does their countries labour laws say about the forced resignation he is talking about before we give him our versions from the different countries we are writing from. Also he should come clear on what exactly happened between himself and his Boss. How long has been with the company.

Dear sir,

what happen is to be understand by some back details as,

Sir there was one Director for this plant who recently left the company @2 to 3months before .

And owner’s relative has taken charge of the company and started to work as his own method.

As per his opinion he wants me to leave company.

One day he called me in his office and told me dear sir ‘ jitane ki mary umar hi utana apaka experience hai.’ But now I cannot afford your salary to this organization. so it will be better u give resignation letter to me and I will keep it with me .and don not discuss with any body.

That day I didn’t say anything. As per his behavior it was not surprising to me.

Because he wanted to push the person to upper post who was under me.

The person who was under me is very closed to owner as his father is also working in the same organization on much more higher post that is considered nxt to owner .

So considering all these things, it was not me easy to survive in organization but still I was working.

Now boss started blaming me i.e. harassing .I think this much is sufficient to understand the situation .

Ok.

afterall it is private company and no more than kirana shop, who is close to owner can eat sugar freely.

but now it is not that much easy to get the job suddenly .

There must be solution on this matter and I am searching for the same.

Dear Arvind,
No one can throw out a good and valuable employee just like that. If that happens either the organization had no value based management or employee oriented management. In either case, it is prudent that you seek employement else where. Also, if you wish to fight it out, do consult a good legal expert in this and proceed further on his advice.Remember, legal systems are not so fast in our country and the outcome of the legal may favor or may not favor you. What are you going to do in the interim period? Do your homework thinking all consequences and then proceed further.

I agree with Mr. Murdhar, resignation at will or resignation by force, its giving up. Here they have not terminated you but have asked you to give resignation wherein you can claim your notice period, wherein you get enough time to search a good job. Secondly you will not forgo the experience certificate which cannot be of any help in case of termination. Last but not the least if you have completed full 5 years you are also entitled for Gratuity etc. So its advisable to go soft instead of jumping directly for legal case against an employer.
I have marked most of the poster want legal action to be taken against the employer, instead of problem solving without thinking that whether the act of legal will harm their future or will have a bad impact on their career. This is my opinion you can take other members advise too.

Please let the forum know the reason for termination to advise accordingly. Any employer cannot terminate an employee without any reason and without any inquiry they have to prove the reason for a severe action like termination.
With regards to resume your work again in the same company, the employee has to prove his/her innocence for the leveled charges against him/her during their domestic inquiry.
