Dear Sir,

Good afternoon. We are hiring an employee from the U.K. who is above 58 years old. Now, the issue at hand is whether I can deduct PF contributions from their salary. If we do deduct, please inform me of the rules that apply.

Dear Abhishek,

Why do you want so much complication on the issue? Please do not declare it as salary. Instead, you can refer to it as honorarium, in which you will deduct only TDS Part, and the balance you can directly pay to him. Furthermore, do not state that he is your employee. He is your adviser/consultant. After 58 years, what work can he do except giving valuable advice to run your show.
