I worked for a management consultancy named EVOLUTION PARTNERS based in Mumbai for 9 months. I resigned in November after serving my notice period. The company is not settling my dues. They do not respond to my emails and phone calls. If I call from an unknown number, they ask me to call later and then never answer. This is the situation for many ex-employees of the company, except for those from an IIM background. This is discrimination at its worst.
Furthermore, TDS has been deducted from my salary every month, but it has never been passed on to the government. Despite repeated reminders for tax filing, the director did not provide Form 16A. For other employees, PF deductions were made regularly, but none of them received any money when they left.
Please advise me on the steps I can take. Companies like this, lacking integrity and breaching trust, should be penalized by the law.

Case 1: If your TDS has been deducted and they have issued you a payslip mentioning the deduction amount, you can approach the IT department (before drafting a letter) mentioning all relevant deductions as shown in the payslip. Once this process is completed, the IT department will take necessary action. Simultaneously, you can submit the same copy to the labor department, which will also take stern action against them.
Just in case they have not officially given you any intimation regarding TDS deduction, then the above case would be weak.
Case 2: No response for settlement: When you handed over, did they provide you with the details of the amount due to you after resignation?
Problem area from your side: Is there any specific action taken by you because of which they are taking such actions?
I would suggest you approach the labor commission and send them a notice whereby they would be forced to attend to your case.
For that, you would require documents like I mentioned above to strengthen your case.
