Dear Seniors, I am working in an engineering company....employee strength is 55....i have completed 6 month.....tell me that what will be the criteria to terminate the employees......

Hi Minakshi,

Termination is a process in which you have to be very strong in the reason for terminating an employee. You should have enough evidence of his wrong deeds so that even if he moves to the Labor Court, he loses the case.

However, your company should have standing orders. You should follow those standing orders while terminating an employee. Also, you should mention the clause under which you are terminating the employee in his termination letter.

my boss is asking resignation letter from me,,,,,,because i asked one employee to give a letter because he is suffering from fever....

Employee is suffering from TB. As TB is a contagious disease, so I asked for a letter stating that if during official hours the employee is facing any problems, then the company will not be responsible. As an HR professional, I don't think it's wrong to ask for this kind of letter. Please advise.

Dear Minakshi,

Regarding the health aspect of the other individual and the Company's interests, you have requested a letter from him. However, consider another perspective, specifically the humanitarian aspect. Please confirm whether he contracted TB due to Occupational Hazards. If so, your Company could be held accountable. Otherwise, offer him an alternative assignment that will not impact the Organizational Climate/Environment.

Dear Manisha,

If an employee is suffering from a disease, it is the headache of top management to make the decision on this. Your job is only to convey the message to your boss. If your boss is not convinced, then you have to try to convince him, or else you need to change your job for your mental satisfaction. Otherwise, it is too difficult to work in these circumstances.

Regarding Termination Criteria & Procedures, I can explain with an example from my country, Mozambique. Our labor law defines three kinds of work contracts: permanent, eventual, and short-term (3-6 months). I do not know what kind of work contract you have or have had for your employees. For termination, you can choose between two principal ways: negotiation with the employee or addressing their behavior during their tenure at the company. In conclusion, you should have strong reasons for termination and verify what your labor law states regarding this matter.
