Dear Seniors,

Our company falls under "The Punjab Shops and Commercial Establishments Act, 1958". Are employees on probation liable for any type of leave such as Earned Leave (EL), Casual Leave (CL), or Sick Leave (SL)? My company policy is silent on this matter.

It all depends on the company policies. In my knowledge, no leave is granted under probation except CL. However, advance PL is considered depending on exigencies. Pon

Dear Rajni,

For Casual Leave and Sick leave, kindly refer to "The Punjab Shops and Commercial Establishments Act, 1958" Section 14(4) for the same.

"Notwithstanding anything contained in the foregoing sub-section, every employee in an establishment shall be allowed with wages seven days of casual leave and seven days of sick leave in a year."

On the other hand, the entitlement of Earned Leave (EL) depends upon the company policy.

The first thing is that you have to go through the leave rules mentioned in factory act and THE PUNJAB INDUSTRIAL ESTABLISHMENT (NATIONAL AND FESTIVAL HOLIDAYS & CASUAL AND SICK LEAVE) ACT, 1965 (6.1 – 6.6) (Punjab Act 14 of 1965) for complete details and eligibility.
Well you also can understand that these CL & SL are necessary need of every one and every employee who is working for 8 hrs in a day no matter is on probation or regular employee can avail and are eligible.

  • Factories Act is not applicable in instant case since the query is about Shop or Commercial Establishments.
  • The Punjab Industrial Establishment National & Festival Holidays & Casual & Sick Leaves Act is also not applicable in instant case. Since definition of Industrial Establishment given in Act dose not cover Shops & Establishments.
