Dear Sir,
I was on leave on 25th and 26th Feb 2010, and my BM, when sending attendance for salary release in a salary format through mail, kept my superior in CC. My superior, without informing the BM, changed my leave into absent. Finally, when I approached higher authorities, they also took the side of my superior and ignored the fact that my leave was approved by BM.
In the month of April, I emailed for sick leave as I was sick, but my superior outrightly rejected the same. However, the doctor told me that I needed rest because I had pain in my testes. Consequently, my superior made an absconding case against me and kept the HO in the dark. The company terminated me even though I showed all medical documents to the HR department, but they only gave one answer: "You are terminated; now we cannot do anything." Can you suggest what I should do now?
Thanks and regards,
Zaffar

Dear Zaffar,
I think the company is not in need of you. However, that does not ipso facto give them a right to terminate you like this. Can you send me a list of dates with good details? Did you send any mail or letter to the company recording the entire fact? Kindly send the details so that we may help you.

Dear sir,
I have uploaded all the documents. Please check. There is leave approved by BM on (25th and 26th Feb 2010) and an attendance register photocopy where leave is marked, and BM has attested the attendance before sending the attendance in an attendance format for salary release. The salary cycle starts from the 19th to the 18th of every month.
Also, medical documents are attached.
When I came back from a medical check-up after 25 days and rejoined the office, my state head told me to rejoin the company because my leave was not sanctioned by my superior, but three absconding letters were issued to me and sent to my home address as I was away from home for the last 25 days.
I refused to rejoin the company because I was not absconding; even my BM was well aware of the fact because I verbally informed him and also handed over the leave to him, but I don't know why he did not sanction the same. Finally, the Branch HR sent my case for termination, and no termination letter was issued to me. On my Full and Final Statement, it was mentioned that I submitted the resignation on the 28th of May 2010.
Also, they generated two Full and Final Statements of mine. In the first one, they mentioned my last day of work as 31st March 2009 and harassed me to pay 6796 rupees to the company, threatening legal action against me. However, when I informed them that I was in the office until the 10th of April 2010 before taking leave, they generated my second Full and Final Statement. It is essential to mention here that when they generated my first End of Duty letter stating my last working day as 31st March 2009, they said the company could not take me back because the EOD letter was generated. However, when they realized the error, they issued the second EOD letter, keeping me in the dark. I raised all these questions with the HR department, but nothing was done in my favor.
Finally, the Head Office informed me that it was the Branch HR who presented my case for termination, following the proper absconding process, and termination was carried out as per company policy.
The wording below is from a person in the Pune HR department who wrote to me:
Dear Zaffar,
Please give me time until today EOD, and I will revert to you on this case. I have been following up with our Legal team because once an employee is terminated, we cannot reinstate/reactivate the E code. Also, in the below case, it was your State HR - Mr. Mukesh Pratap Singh who took the lead and highlighted the case to us. He is also trying his level best to resolve the case.
Because State HR - Mr. Mukesh Pratap Singh was directly involved in my case and he blindly presented my case for termination, to save him, they ignored all my requests.
Therefore, I request you to check the documents and suggest what I should do now.

Dear Sir,
On 24.02.2010, I applied for casual leave for two days starting from 25th Feb to 26th Feb, which was sanctioned by the Branch Manager.
On 27.02.2010, it was a holiday in Doda Satellite Branch due to Eid Milad.
On 28.02.2010, it was Sunday.
On 31.03.2010, I received my salary slip, which only accounted for 28 days (as the salary cycle starts from the 19th to the 18th of every month).
I informed my superior, Mr. Dheeraj Gupta (Assistant Branch Supervisor), through email and telephone about my leave. However, he changed the attendance format sent by the Branch Manager and marked me as 3 absences and 2 leaves (he tampered with the format). No action was taken against him, and he failed to provide any evidence for the days marked as absences.
Until 31.03.2010, the Branch Manager was aware of my sickness and was verbally informed that I needed leave.
From 01/04/2010, the Branch Manager was in Jammu, while I and the office boy were present in the office.
On 10.04.2010, I sent a sick leave request to Mr. Dheeraj Gupta through email, attaching the hospital doctor's check slip. However, he rejected the request without providing any reason. I informed the Branch Manager the same day since he was also in CC, and the State Head was kept informed as well.
On 07.05.2010, I returned after a medical checkup and rejoined the office, but my State Head, Mr. Pradeep Ohri, instructed me to rejoin.
On 01/05/2010, the company transferred Mr. Sushant Dubey to my position at Branch Doda without issuing any transfer letter or giving me prior notice. No transfer or termination letter has been issued to me to date, but the company system shows me as resigned or terminated.
On 11.05.2010, I showed my medical documents to the Branch Manager in the Doda office, informing HR and my superior that I was sick. However, the company terminated my employment on 21.05.2010 because the State HR, Mr. Mukesh Partab Singh, misrepresented my case to the Head Office, resulting in my termination. They falsely claimed that I submitted a resignation in the Full and Final settlement statement on 28th May 2010.
Upon returning to the office after 25 days, I noticed in the attendance register that the Branch Manager had marked himself present from 1st April 2010 to 30th April 2010 with 'P,' indicating his presence. It seems he had been signing in for the past two years but suddenly stopped in April. The HR department did not address this issue, questioning why the Branch Manager made this error. Despite his absence, no absconding letter was issued to him, and no action was taken. In contrast, when we apply for leave, it is promptly rejected, and HR takes immediate action against us.
Thank you and regards,
Zaffar

Dear Sir,
In October 2010, I was terminated by force by the company, and I submitted a case in the labor court. Now, after approximately three years, I won the case because the company did not attend the court during these three years. The case is now ex-parte. The court has sent multiple notices to the company for appeal, but they have not appeared. Finally, one month ago, the court sent them the final notice for appeal, which they ignored. Now, the court will send them a notice to pay me the three years' salary. Will the company pay or not, as the labor court decision is in my favor?
