Dear All,
Please clarify my following doubts.
1. Who is legally responsible to get registartion as per BOCW act - principal employer or contractor.
2. If principal employer is already registered with the concerned authority as per said act for a particular project, whether the contractor working under him in same project is also required to do registration or not.

This act called as Building and Other Construction of Workers Act, under this act principal employer is the ultimate responsible for all kind of issues, but under this act anybody can take registration means contractor or principal employer but principal employer as to pay the 1% cess to labour dept on total cost of the project for (ex: if project cost is 100 rs have to pay 1 rs) and registers as to maintain in the project cite' but not applicable to factory primises' and for construction ESI not app.

Thank you very much for your valuable reply.
Is there any act governing that the BOCW Act is not applicable in Factory Premises and for Construction Sites ESI is not applicable.
The same is required to be produced to our client for avoiding repitition of multiples of same work.

Hello
BOCW and Factory act can run symultaneously. e.g If capacity is increased in existing factory setup additional construction is required. So the factory act and BOCW both are applicable. There is orissa high court judgement state of orissa Vs sterlite. Pl refer it.

Dear All
Situation is that, in a construction site all the contractors have taken registration under BOCW Act.
If the Principal Employer will take registration under Factories Act , what will be the consequences.
1. All the contractors have to surrender their BOCW , RC
2. CESS won’t be paid to the BOCW Authority from the date of Factory License implementation to that site..
Please give solution/suggestions

Once the factory is started running and production is started then obviously the BOCW Act will not apply and the RC under BOCW Act becomes null and void. But in the running factory, the further construction approval to be obtained from the Factories Inspector and while issuing the approval, the concerned Factories Authorities will instruct the occupier to pay the BOCWW Cess before giving approval for further construction.
