We are SS Unit covered under Shop Act .
One of our employee ( has joined just before 2-3 days and she is on probation period for 6 months )has done misconduct -misbehave and abused to seniors.
What action should be taken against the empolyee
Can we give Writen memo/warning?
or directly give the Charge Sheet ?
1) Written Warning
2) EXPLANATION OF DELIQUENT EMPLOYEE

3) SHOW CAUSE NOTICE / CHARGESHEET ISSUED TO THE DELIQUENT EMPLOYEE.
4)EXPLANATION OF DELIQUENT EMPLOYEE
5)EXPLANATION SATISFACTORY – MATTER CLOSED
6)EXPLANATION NOT SATISFACTORY – DOMESTIC ENQUIRY
7)APPOINTMENT OF ENQUIRY OFFICER
8)RECORDING OF ENQUIRY PROCEEDINGS

Hi Shilpa,

You should give her the written memo for misbehaving with seniors. Also, ask for the justification from her for behaving in such a manner in writing. (Sometimes it may happen that she is not at fault, but as we are not aware of the fact, we may sue the wrong person.) Based on the explanation given by her, if she is at fault, give her the written warning; otherwise, ask her to send an apology letter to the seniors accepting her mistake. Give her at least one chance. If she repeats this behavior in the future, you may sue her.

It is better not to go for a domestic enquiry. Instead, speak to the employee, try to understand the whole scenario, and conduct a counseling session. Discuss the matter with seniors, explain the case, and if everyone is convinced, give the employee a chance to submit an appeal and then close the case.
