In PF-19 & 10C form, what is the Date of leaving? For example, if an employee worked up to the 13th of September 2009 (last day of working), should the date of leaving be 13th September, 2009, or 14th September, 2009?

Do not be confused. The date of leaving, as per any act and also in general, will be the last working day only. In your example, the 13th will be the date of leaving. At the close of the 13th, the outgoing person has to hand over charge and leave, whether it be termination, retirement, resignation, or any other form of departure. It is very clear that on the next day, i.e., the 14th, they have no further involvement with the company affairs. Therefore, it is evident that the closing hour of work on the 13th will be considered the date of leaving.

I can also clarify one point. When a man dies in the factory or office on the 13th, what will be his last working day? The day of death only, naturally. This applies in all cases. In other scenarios, all are considered to be alive until the closing hours of the 13th only. That is the day up to which the company will be liable to pay full and final settlement. The company has no obligations towards him the next day. It should be noted that the last working day would also be the last payable day by the employer and the official date of leaving. There is no employer-employee relationship the following day.
Similarly, for someone who completes their third shift from 10 p.m. on the 13th to 6 a.m. on the 14th (8 hours), their last working day would still be the 13th since they are working only on the 13th, even if they finish at 6 a.m. the next morning. Therefore, the 13th would be considered the date of leaving, as it was their last scheduled workday.

You should treat that date as the date of relieving until which you have paid PF for a particular employee. As per the above example, if the employee left on the 13th of the month, and the PF amount was paid until the 13th, then the Date of Leaving in Form 10 C and 19 should be the 13th. If the payment was made until the end of that month, we should consider the 30th or 31st of that month as the Date of Leaving.

A very valid doubt raised by an HR colleague. It should be understood that the last working day is the same as the date of leaving. If your company has a practice of issuing relieving letters, it clearly states that - XYZ would be relieved by the closing hours of ddmmyyyy. So one should not get confused with the terminology used to describe the same thing. The employer/employee relationship ceases on the last working day of the employee in the organization.
