I am working in a manufacturing company as a personnel manager. In a labor court case, our advocate advised us to give witness on behalf of management. Accordingly, myself and the Personnel officer signed the paper, and after that, we may attend court in December 08. So, I need advice from all of you. Suppose I will join somewhere else during the case period, then what will happen? Kindly advise.

In such legal proceedings, you are appearing as Personnel Manager/Officer of the company and not in your personal capacity. Upon your resignation, the successor can represent the company and act on your behalf by filing the necessary revision in the vakalat. If your name has been mentioned as a witness, you are required to attend the proceedings. Typically, on the day of the hearing, you can request leave from your current organization to attend the case. I do not believe any employer would reject such a leave request.

Hi,
I was an employee of an IT-telecom company which got shutdown last month. The owner hasn't paid us (15-20 employees) past 3 months' salary, which comes around 4-5 lakhs. The owner had provided a written promise that he will pay the 1-month salary, around 1 lakh, by the 15th of this month anyhow and the remaining amount by the 30th. He even gave us a post-dated cheque from his personal account. He said that the official account would be closed by the next day, and they can't show the flow of transactions in that account.
The person is not responding to our calls anymore. We are lost because every employee is owed around 20-25k. If we go to the labor court, how much will it cost and how long will it take to get a resolution?
