Please help me with the following case: One of our employees was sent on a 2-month leave without pay for his misconduct. After 1 month, he sends his resignation by mail. (Our company has a notice period of 1 month.) Should I relieve him after 1 month from now, even though he is on leave during this period? Or does he not receive any service certificate, relieving letter, etc., from our company? Please guide me.

Already, he is causing issues with the personnel in your organization. If he has submitted his resignation, do not delay in accepting it; proceed with acknowledging and relieving him of his duties. By issuing a letter of relieving, it is not a statement of approval regarding his behavior but simply a formal notification of his release from official responsibilities.

Dear Srishtee,

Just accept it and do nothing. Let him approach you. Provide all formal letters after 2 months from now. Thus, the notice period is fulfilled. If he asks for immediate release, ask him to pay for the notice period. Two months' leave is not considered under the notice period.
