Probation is the period during which an employee requires due supervision and reasonable training. Since an employee is posted after a written test and or personal interview and it is not possible to judge the capability of a person to do a prescribed job, he/ she will be initially posted as probationer during which his/ her service will be assessed properly. During this period the employee will be given orientation also.
The length of probation period and confirmation of probation will depend on the policy of the respective management. There is no specific law governing probation and confirmation. As such, probation shall not be taken as a period during which the employer is at his liberty to do any sort of harm to the employee. Since right from the day one of service onwards, an employee is covered by EPF, ESI and similar Acts, leave shall be given to an employee under probation. As earlier stated, the number of leave to which he is entitled will be according to the policy of the management. However, denying leave shall be contrary to the principles of natural justice.
