I was with "All India Radio" and resigned after a "Continuous Service" of 8yrs 10 months. I was not aware of Gratuity will be paid if the service is more than 5 yrs. When I contacted my earlier Employer Office (Jagdalpur, Chattisgharh), they informed me that Pay & Accounts Office (Bombay) refused to pay the Gratuity because it is "Resignation" but not retirement or disability or death. I want to know -
1. Because I resigned, am I eligible for Gratuity?
2. If yes, because Gratuity has to be paid within 30 days, can I claim for any interest?
3. All India Radio was "Central Govt Dept" till around 1999 (or 1998), later it became "Prasar Bharathi". Will this make any difference in making the Gratuity Payment?
4. Which rule or reference (preferably a book) should I provide to convince them?
