Respected Sir/Madam,
I wish to file a formal complaint against my employer, HCL Technologies, regarding an unjust “absconding” action taken against me, despite my continuous communication and submission of valid medical proof.
1. I was employed with HCL Technologies as an SAP professional.
• When I was instructed to report to the office, I was medically unwell due to high diabetes and high blood pressure.
• I had informed the HR team through email about my health condition and inability to travel, as medically advised.
• Upon the HR representative’s request (Ms. Annu), I had submitted my medical reports as proof.
2. Despite providing full medical explanation and documentation, the company has:
• Wrongly marked me as absconding
• Denied issuance of my Relieving Letter
• Denied issuance of my Experience Letter
• This is preventing me from finding new employment
The “absconding” tag has been applied without proper inquiry, despite my written communication and cooperation.
3. Due to the company’s action:
• I am facing severe mental stress
• My wife is under emotional distress, often crying due to the uncertainty
• My children’s education is affected, as I am unable to pay school fees
• As the sole earning member, my family is in financial crisis
• This situation has severely impacted my dignity and livelihood
4. I have repeatedly requested the company to:
• Review and remove the absconding status
• Provide my Relieving and Experience Letters
• Allow me to secure future employment
However, I have not received any response or support from the HR team.
5. Request for Government Intervention
I humbly request the respected authority to kindly intervene and direct HCL Technologies to:
1. Reconsider and remove the wrongful absconding status
2. Issue my Relieving Letter
3. Issue my Experience Letter
4. Ensure a fair and proper handling of my case
I have always been compliant, cooperative, and have provided all required documents. The present situation is beyond my control and is causing extreme hardship to my entire family.
I request your kind support in resolving this matter at the earliest.
Sincerely,
[Shrawan kumar

I'm sorry to hear about your situation, Shrawan. Here's a step-by-step plan to address your issue:
1. Document Everything: Keep a record of all your communications with the HR department and any medical documents you've submitted. This will serve as evidence of your attempts to communicate your health condition and inability to work.
2. Legal Consultation: Consult with a labor law attorney to understand your rights and possible legal recourse. The Indian labor laws, specifically the Industrial Disputes Act, 1947, may provide some guidance on your rights as an employee.
3. Contact Higher Authorities: If your attempts to communicate with the HR department have been unsuccessful, consider escalating the issue to higher management within the company. Be sure to provide all relevant documentation.
4. File a Complaint: If the company still doesn't respond, you can file a complaint with the labor commissioner in your state. Provide all necessary documentation and clearly state your grievances.
5. Seek Employment Elsewhere: While you're pursuing this, start looking for employment elsewhere. If potential employers ask about your situation, be honest and provide as much detail as necessary.
Remember, it's important to maintain a calm and professional demeanor throughout this process. While this is undoubtedly a stressful situation, reacting impulsively could potentially harm your case. Stay strong and remember your rights as an employee.

Dear Shrawan Kumar,
What has happened to you is unfortunate. However, adversities are part and parcel of life. They make us wise. Against this backdrop, please do not take tension. It could aggravate your disease further. Advise your wife also to maintain equanimity.
Now, coming to providing a solution to the challenging situation. In your post, you have not written what your designation was, nor how many subordinates reported to you. If nobody reported to you, then you can file a complaint with the labour office. Very recently, I have written on filing the complaint. Click the following link and read the fifth paragraph onwards:

In the meantime, you can ask for an interview with the Head of HR. Go personally and explain your problem.
Keep on providing further information, and we will guide you as things unfold.
I wish you all the best!
Thanks,
Dinesh Divekar

Are you sure that the company had marked you as "absconding"? Or is it marked as "abandoned"? Absconding is a serious offence and is not used by an officer (HR or similar) of a Private company. A person is declared absconding by a Judge or the Police only when he is not traceable. In your case, you are very well available and you can be asked to come in front of any authority, right?
Now, coming to the situation, if your HR Manager is not satisfied by the health records submitted by you, you can be asked to report to office by sending an official mail in this regard. Without following this basic step, the HR cannot block you and treat you as abandoned the job. The act of the HR can be questioned saying that you have been working from home, and without notice the entry was blocked. But being a big corporate, I don't think that you will win the fight. But you can fight if the HR had failed to follow the procedures to be followed such scenarios. Please refer in detail what are the procedures to be followed in withdrawing work from home.

(Fact Checked)-Your advice is sound, Dinesh. It's crucial to maintain calm and seek legal advice. Meeting with the Head of HR can also be beneficial. Keep going! (1 Acknowledge point)
