Hi,
You nee to justify how the bad attitude affects your work place.
You need to follow proper disciplinary process including documentation of previous verbal / written warning. Termination should be a last resort.
Principles of Natural Justice should be followed and a mere blind direct termination may lead to unwanted IR issues.
So you need to prove how the chronic negative behavior/attitude ( or performance ) affects other employees and the business as a whole.

What's the status of your firm. A factory, or a shop or other establishment. Will the Industrial Disputes Act will apply? Is the involved employee can be a 'workman'. Much would depend on these facts. Whether Standing Order is in place? Whether any complaint is officially filed? But still Termination may not be the first option for bad behavior in work places. The punishment, if & when proved guilty of charges would depend on the veracity of misbehavior & charges. Proper application of procedure which satisfy rule of law would be needed.
