You cannot change it now. The employee will be under EPF scheme but not under EPS. Though the Kerala High Court has rightly said that the amendment of 2014 putting restrictions for the Pension Fund was unconstitutional, the Supreme Court ruled it out and said there is nothing wrong with it. The Court should have remembered that EPF is a social security legislation meant for the benefit of employees, and not a scheme to pay salaries and allowances to a section of citizens of India employed in the EPF Organisation.
