Hi,

Form-16 is the TDS certificate issued by your employer when they deduct TDS. When an employer deducts TDS on salaries, the Income Tax Act requires that a certificate be issued by the employer, where the details of tax deducted and deposited are certified.

So the issue of Form 16 (subject to applicability) has nothing to do with termination. The issue of Form 16 will help the employee to file IT returns. An employer cannot deny issuing Form 16.

Regarding the relieving letter, as already clarified in another thread, the issue of a relieving letter for termination cases, the termination letter will be the proof for the closure of the contract. Some employers might issue a certificate mentioning the termination and the reason.
