Kindly clarify whether the person in lien from one PSU to other PSU can be retain same seniority after returning to his parent PSU?
From India, Faridabad
Lien on employment in such situation depends on the contract of employment. Unless otherwise provided, there is no lien on employment once he leaves the job. But if he was hired to occupy a post caused due to leave of a permanent employee and has to leave the job on the latter's rejoining he may get priority of employment when a new vacancy is reported. But this right to employment will not be available in another PSU. Still, he can show it as an experience and on the basis of it he can be considered not as a right.

Retaining lien in the previous company gives the person only an option to return back to that company. For any reason the employee wants to go back, if lien is retained then the employee can resume duty in the post and pay lastly held by such employee. Protection of seniority is generally not allowed, it sounds improper and inappropriate, unless it is specified to the contrary in the order on lien . So, on return to the previous organisation, the seniority has to be reckoned again with continuity of service, blanking out the intervening period.
