Hi, What original documents you are planning to collect from employees. Collecting original certificates from employees is not legal. You may verify original certificates and give back to employees.

Hi,
Collecting original certificates is not legally right. It is just an act of forcing employees to be with the Organisation for stipulated time frame even if they are not interested just for the sake of original certificate.

Rather why not you can implement certain monetary rewards like.. employee completing two years will get 10k instantly.. etc. Also ensure congenial, healthy work environment to attract and retain employees.

Dear H-R1,
Employers can ask for original documents just to verify them with theXerox copy employer can ask only for verification purposes not for storage purposes. Please note that this is against the law you can not do anything forcefully with any employee.
You can do but this is absolutely illegal for a EMPLOYER to keep original documents of any employee.Employee can go to labour department against employer and in such case labour department would be consider it as a Bonded labour and Bonded Labour is prohibited in India by law vide Articles 21 and 23 of the Constitution.

*If management wants to implement such type of thing then you can go for employment agreement otherwise need to issue acknowledgement letter stating what kind of certificates you possess and when these original documents will be returned.
