In death cases, the qualifying requirements of 10 years service is not required. The dependent spouse can apply for pension even if the deceased member has not completed 10 years of service.

Dear Madhu,

Please send me the link to the act or law that mentions when a spouse can claim pension if the deceased member has not completed 10 years of service. I believe labor laws are similar in Pakistan and India.

Thank you,

I don't know what is there in Pakistan's labor law, but in India, it is regulated by the Employees' Provident Fund and Miscellaneous Provisions Act, 1952. Under the said Act, there are three schemes: Provident Fund Schemes, Pension Schemes, and Employees' Deposit Linked Insurance Schemes. Of these, paragraph 16 of the Pension Schemes addresses widow pension, which is available to the widow of a member. It is also stated that a contribution to the pension scheme for at least one month is required to enable the widow to receive this pension.

Dear Puja,

In the case of the death of a member, 10 years of service for qualification of pension is not required. If a member dies at any time after becoming a member, even if not completing 10 years of service, the family is entitled to family pension. This provision is already stated in the act.
