Dear members, Attached kindly find a paper cutting regarding 3rd Time Maternity Leave, okayed by MP High Court. This will be beneficial to remarried women employees in Companies.

The ruling is applicable to government employees Private companies are not required to follow it, I think.

Maternity leave and marriage have no connection. There is nothing in the Act which says that only married women will be eligible for maternity leave. The same will apply to remarriage as well. If we follow the verdict, a woman employee will get maternity benefits 'under each marriage.' At the same time, what the law says is that a woman employee having two surviving children is eligible for 26 weeks of leave. If the employee has more than 2 surviving children, then she will also get leave, but it will be for 12 weeks. That means the number of surviving children will decide the number of maternity leave to which an employee is eligible, not the marital status.

Yes, provided your establishment is covered by Maternity Benefits Act and the employee concerned is not under the ESI Scheme.
