The Management agrees to pay the salary amount, but the HR Manager holding the salary, can I make a complaint against the HR Manager in Labour office to get the salary. Guide Me.

How do you know for certain, that HR-Manager is holding your salary when the Management agrees to pay it? Whom do you assume as Management?
Any decision by the Management, through any one of the decision making authorities, in the establishment, is normally with some valid reasons / justification and based on policy and procedures. Whoever conveys the order is ‘for and on behalf of the Management only’
For non receipt of salary, you are always open to file a claim before the labour officer, against the Management and not against the HR-Manager.

Hi,

As explained by Mr.Babu, Management is an entity formed by authorities who are capable of framing policies, procedures and implementing it. If the decision comes form the management it will be implemented by any designated authority possibly by the HR for issues like discipline, organisation culture, managing people, compensation, employee welfare, Training and development etc.

You have raised a query for making a complaint against the HR Manager. On your query, a senior member has raised a few questions. Though you have given a reply, the information provided is not sufficient. Against this backdrop, please clarify the following:

a) You have written that "management has agreed to pay the salary amount". However, why the salary was not paid? What was the reason?

b) If the management agreed to pay the salary, then have they given a commitment in writing? Has this also been passed on to the HR Manager?

c) If the salary is not disbursed, though the management has agreed to pay, then did you approach the HR Manager? If yes, how? What is his take for not disbursing the salary?

d) If not the HR Manager, then did you follow up with the management for not getting the salary? If yes, then what was their take?

At this stage, getting the salary is important for you. Therefore, in a fit of rage, do not make a complaint against anyone. The HR Manager acts on the instructions of the management. A complaint against him will be considered a complaint as a company. Against this backdrop, you could muddle the issue. Therefore, tread cautiously.

Before you make a complaint, you need to have proof of proper correspondence. Whenever you make a call, please be polite. However, record the telephone call on your mobile. Whenever you write an email, take a printout and keep it with you.
