Hi,

I have a question on EPF contribution from the employer on Maternity leave. I saw the discussion but still have a small doubt.

My wife's EPF account is showing blank, which means no contribution happened between Apr '19 to Oct '19. She later rejoined on Nov 5th, 2019, and worked for some days before resigning.

From Jan 2020 till date, I've been trying to get a full settlement of EPF but have not been able to. I have called the respective HR several times, but there is still no solution.

While trying to get the amount, it's showing the message "Apr to Oct no contribution. Contact Employer."

Please provide your response so that I can resolve this.

If during maternity leave period you had received a salary (assuming that you were not under ESI), contribution to PF should have been deducted and paid. Non-payment of contribution is a non-compliance on the part of the employer, for which you as a member of PF cannot be denied your claim. If they had not paid salary during your maternity period, they should have shown these days as non-contributory. Then also the system would accept your claim. Therefore, the only remedy available is to ask the employer to pay contributions or file a petition before the Asst Provident Fund Commissioner narrating the issue and seeking to intervene. If you proceed like this, the EPFO will direct the employer to remit the PF contributions omitted with interest and damages as per separate notices and settle the claim.
