I applied for a new contract labor license on the TS Labour website. It took a security deposit in the TS Treasury Bank, Ranga Reddy. I paid to the DDO code JCL, but the correct code was DCL. The Labor License authority rejected the application. How can I collect the security deposit from the Labor Department?

Dear Jayashankar Prasad,

You have paid the security deposit into the wrong account, and therefore your application is rejected.

You need to rectify your mistake. Until the Labour Department receives the required payment(s) from you in the respective account, no license will be issued to you, and you will be treated as a defaulter.

You have to apply to the respective officer DDO, i.e., Drawing and Disbursing Officer, to rectify your mistake and request him to transfer the amount to the correct account.

If you have paid later on in the correct account to have your license approved and now want to collect the amount paid earlier incorrectly, then also you have to approach the DDO. To get a refund from the DDO, you have to contact the respective DDO.

Given the unique issue with the DDO under Telangana rules/regulations, I feel there is no guarantee that you will receive a better response here than this.

As far as my knowledge is concerned, there is one rule currently in effect stating that no security deposit will be refunded after the completion of any contract.

In your case, you have remitted to a higher designated officer instead of an immediate subordinate officer. Actually, there is nothing wrong with this as the account is related to the department only, not to the designation. Therefore, please approach both concerned officers. I believe the application may have been rejected by JCL with some other reason or based on the number of workers' jurisdiction as per GOMS No. 33. However, since you have deposited the amount into the department's account, your money is safe.

Please approach DCL for the conversion or transfer of the amount from JCL to DCL. I think it will be processed positively. As there is no specific JCL account for security deposits and DCL account for security deposits, all transactions are managed under the Telangana Labour Department account only. Please remember that only conversion or transfer is possible; there is no provision for the return of security deposits.

The application seems to have been rejected solely because it was addressed to an authority without jurisdiction and not because of remittance into the wrong head of the account, if any. Therefore, you can apply to the jurisdictional authority with the same remittance particulars. If the website does not permit such an attempt, submit the application physically. After all, the condition of the security deposit stands already complied with.

In case a fresh application was submitted subsequently to the jurisdictional authority with yet another remittance, you can claim the deposit made earlier as suggested by Mr. Akhil.

Our learned friend Gannahope's opening remarks seem unacceptable to me. No security deposit can be refused to be refunded when the purpose of which becomes duly completed or when the application for a license is rejected.
