Hello Sir/Madam,

I joined a new organization in January 2020. I was asked for an Aadhaar card to enroll in EPF, so I informed that I do not have an Aadhaar card. At that time, the company was not registered with the EPF office. However, from my January salary, the company deducted PF from my salary. In April, the company asked me again for the Aadhaar card. I tried to get an Aadhaar card, but most of the centers in Chennai were closed due to Covid-19. Due to the lack of revenue, the company decided in mid-June to permanently lay off a few employees, and unfortunately, I was on the list. July 31st is my last working day, and this month I am on a 25% salary. They are now requesting the Aadhaar card to create UAN, which is not possible as I even went to the post office yesterday to obtain the Aadhaar card.

My current situation puts me at risk of losing my PF contribution money. What are my options? Will I receive both my contribution and employer contribution? Can I request them to transfer the amount to my salary bank account?

Additionally, I have a company laptop that I need to return. When would be the right time to hand over the laptop?

I want this process to be fair. Please provide advice. I am in a situation where I need to pay my son's school fees, and this PF money will be of significant help.

Thanks,
John

John, I understand your concern regarding your EPF enrollment and the impending loss of your PF contribution money. Here are some steps you can take to address your situation:

1. Contact EPF Office: Reach out to the EPF office directly to explain your circumstances. They may provide guidance on alternative ways to enroll without an Aadhaar card during the closure of centers in Chennai.

2. Request for Transfer: You have the right to claim both your contribution and the employer's contribution to your PF account. Request your employer to transfer the accumulated amount to your salary bank account if you are unable to enroll in EPF due to the Aadhaar card requirement.

3. Returning Company Laptop: Regarding the company laptop, it is advisable to return it as soon as possible after your last working day, preferably on or before July 31st. This ensures a smooth transition and demonstrates your commitment to completing all necessary formalities.

4. Fair Process: Emphasize to your employer the importance of a fair process, especially during these challenging times. Clearly communicate your financial needs and the significance of the PF money for your son's school fees.

5. Legal Rights: As per Indian labor laws, you are entitled to your PF contributions, and your employer is obligated to facilitate the transfer of these funds. If needed, seek legal advice or assistance from relevant authorities to ensure your rights are upheld.

6. Document Communication: Keep records of all communication with your employer, including requests for PF transfer and the return of the company laptop. This documentation can serve as evidence in case of any disputes.

7. Seek Support: If you encounter difficulties in resolving these issues internally, consider seeking support from labor unions, legal aid organizations, or government labor departments for further assistance.

Taking proactive steps and advocating for your rights can help safeguard your PF contributions and ensure a fair resolution to your current predicament.
