Dear Senior,

Kindly advise as per the UP Industrial Disputes Act of 1947. The laid-off compensation is 50% of Basic & DA to be given to the laid-off employee during the layoff period. However, as per the definition of Wages under the UP Industrial Disputes Act of 1947, wages mean all remuneration capable of being expressed, including allowances.

Kindly advise - will the laid-off compensation calculation be based on Basic + DA or Gross salary for the laid-off employee.

Dear VK,

The layoff compensation shall be paid on that component of wages which attract regular pay. Usually, we pay on Basic + VDA (Minimum Wages) which is higher and at 50% of that amount. Only ESI contribution will be deducted on that amount.
