I would like to get views on application on ESIC on Trainess who are as good as apprentices but their Designation is Trainee and they are getting stipend less than Rs 10000 per Month.

Dear Member,
Any person engaged as apprentice under the Apprentice Act, is not covered under the ESI Act. Whereas any person appointed as company apprentice/trainee will be covered under the ESI and they will come under the definition of "workman" under the ESI Act.

If your company having a certified standing order and you have classified trainee employee also in employee catogery of standing order.than you can appoint a trainee in your process. but the limit of enrolment total no. of trainee employees should not exceed as per norms of apprentices act 1961. under this procedure those employees (trainee) recruit by the company they shall be treat as exempt employee under the purview of E.S.I. Act 1948 & E.P.F. & M.P. Act 1952 & no any contribution liability attract on their stipend.
