Please let us know whether Force Majeure can be added to the appointment letter of an employee. Until now, it was not a part of the appointment letter. Due to the recent situation, employers will now prefer it to be included in the appointment letter. Would it be illegal to add it to the appointment letter?

I would appreciate it if you could elaborate on where and for what reason you would like to invoke the 'Force Majeure' (Act of God) in the appointment letter. Are you considering using it for termination or non-payment of salary?

Or for not taking on board an employee who has been given an appointment letter.

Dear Santosh,

An employer can add anything, but will not sustain in the eye of the law if it violates the laws and rules of the land in force. Further, Section 25 of the ID Act deals with lay-off and retrenchment, which considers all the calamities (force majeure) you are talking about. The payment of salary to the employee has been addressed by the government under the advisory, which is above all.
