Dear Sir, under which Act do we have to fix minimum wages for workers at a factory registered under the Factories Act, 1948, and Tamil Nadu Factories Rules, 1950?
Minimum Wages Act and Factory Registration
Based on which act do we need to fix minimum wages for workers at a factory?
Options for Fixing Minimum Wages
To fix minimum wages for workers at a factory:
(i) Do we need to follow the minimum wages declared under the Minimum Wages Act, 1948, and Tamil Nadu Rules, 1953?
(or)
(ii) Do we need to follow the minimum wages declared under the Factories Act, 1948, and Tamil Nadu Factories Rules, 1950?
(or)
(iii) Do we need to follow the minimum wages declared under the Tamil Nadu Shops and Establishments Act, 1947?
We believe that the minimum wages declared under the Minimum Wages Act, 1948, and Tamil Nadu Rules, 1953, are applicable to workers at a factory registered under the Factories Act, 1948, and Tamil Nadu Factories Rules, 1950. Is this correct?
Please advise, sir.

Dear colleague,
You don't need to set minimum wages for your factory in Tamil Nadu yourself. Simply follow the prescribed basic and special allowance (DA) for each skill level as notified by the State government's Labour Department.

Yes, you are correct, Thirumurugan. I think that the schedule appended to the Minimum Wages Act, 1948, classifies the establishments falling under the schedule predominantly industry-wise employments only. When a particular industry is engaged in multiple activities such as manufacturing, marketing, and selling of its products through its exclusive retail outlets, such activities done from its manufactory alone will be covered by the statutory minimum wages applicable to that industry. Meanwhile, the sales outlets coming under the respective State Shops and Establishments Act or any other area like a village would be governed by the minimum wages applicable to shops and establishments only. In this connection, there is no such general classification as "Employment in Factories."
