Dear HR faternity, Can anyone help me framing a charge sheet on proxy punching (punching ones attendance due their absence). Regards.

A charge sheet has to be specific, giving date, time, evidence and names of witnesses which will be used against the employee, hence no general format can be suggested.

Dear Bhavana, Just check the following draft: It has been reported that on (date) at hours, you were caught red-handed by the security personnel on duty at (location of security guard), while you were punching the card of Mr/Ms (complete name of the employee) bearing Employee No unauthorisedly. Also, you were reported to have admitted the fault before the security personnel and given a statement to this effect. Your behavior as referred to above constitutes the following misconduct under the Standing Orders applicable to you: '(i) Proxy Punching (24.5)'.

For Mr. Shobhit Kumar Mittal: Are you sure that the names of witnesses are also quoted in the charge sheet? I don't think so. The charge sheet is served after conducting the domestic inquiry. Either side produces their witnesses in the domestic inquiry, and their roles are limited to the inquiry only. The charge sheet is served once the culpability is established in the domestic inquiry. You can also add the following lines:

"The above act of yours amounts to gross indiscipline and misbehavior and has been viewed very seriously by the management. You are hereby called upon to explain in writing within 72 hours of receipt of this charge sheet as to why necessary disciplinary action should not be taken against you. Failing which, it shall be construed that you have no explanation to offer, and the management shall proceed with the case as it deems fit and proper without any further reference to you."

Names of witnesses are not necessary in the charge sheet. But if the accused refuses to accept the charge sheet, it is a practice followed by the IR department to include two eye-witnesses (their names, designation, and signature) witnessing the refusal of the charge sheet and record it in the copy of the charge sheet and preserve the same in the file.

Dear Madam,

I have the following observations to make:

1. Names of the witnesses are not required to be included at the stage of issuing a Chargesheet.
2. Issuing the chargesheet precedes the conducting of the domestic enquiry and not vice versa.
