Myself Lokesh, working in ABC (MNC) company, I resigned from my current designation because I got an offer from another MNC company. I requested my current organization for early release because it is clearly mentioned in my offer letter that the company will pay or recover salary instead of the notice period. I am ready to pay my basic salary, but the company HR is not allowing me. I am ready to transfer all my responsibilities, which would take a maximum of 1 month, and my notice period is 90 days. I want a 30-day early release.
I am ready to serve a 60-day notice period and also ready to pay the remaining 30 days' salary. My question is, as per corporate industry rules, the company doesn't have the right to hold me. So what should be my further course of action against this?

It is always advisable to leave a company on a soft note rather than getting into a legal tangle. The company cannot hold you if you are willing to compensate for the agreed notice period. The company can ask you to withdraw your resignation by offering a hike in designation/salary if it desires to retain you. Apart from that, the company cannot hold you.
