Dear sir,
In my current employment, the notice period is 3 months as stated in my appointment letter with a Date of Joining (DoJ) of 16-01-2018. I resigned on 28-12-18 and am willing to pay for the remaining days to the company. I provided a 45-day notice of my departure, but they insist on the full 3 months of service.
Upon inquiring about performance incentives, they informed me that if my last day is 31 March 19, I would be eligible for the incentive; otherwise, it would not be provided.
Please guide me on the best course of action in this situation.
Thanks

Hi Dheerendra,
In the circumstances explained, you'll have mostly no option but to serve the full 3 months notice period. However, if your terms & conditions of appointment provide for 'buying' of the notice period, i.e., the rest of the unserved NP of 45 days period, then you'll have a chance of raising this option. Regarding 'performance incentive,' it's possible to get a proportionate incentive for the period you served or becoming eligible for the same. That apart, how about joining the other employer with whom you are trying to join after this resignation by 28th March 2019? Talk to them to gain an extension of the joining time to solve the issue.
