Hi,

If the case is filed by you on behalf of a previous employer, then after resignation, the coordination person/contact person can be changed by giving a notice from the organization to the concerned office to replace you in the legal cases, as you are no longer an employee of the organization.

Once you are no longer an employee of the previous company, the legal status to speak on behalf of the company ceases. Please insist upon the previous employer to nominate a suitable official to take over the cases and depose/speak on behalf of the company as per official designation.

I concur with the views of the learned members, M/s Manoj and Rao. Your statement that you filed the case during your tenure with your previous employer doesn't shed light on whether you were the complainant in the case on behalf of your employer or if you attended the court hearings with the authorization of your employer. It is also unclear whether the case is a Civil Suit or a Criminal Case initiated upon a private complaint. Whatever the situation may be, when you are no longer employed by your previous employer, especially if it is a Company registered under the Companies Act or any other legal entity, only your successor should handle the case you initiated. However, if summoned by the Court as a witness, you can testify based on your knowledge as a former employee of the organization.

Therefore, I recommend that you communicate this legal position to your previous employer.
