When a confidential matter, which should be discussed between two partners in a cabin, one partner has disclosed the information to others unnecessarily. Consequently, the information reached my superior, who questioned how this matter leaked. It was then revealed to me who the culprit was. However, this individual is not under my contract. In this scenario, what should I do?

Your query is confusing.

NDA is for information to be safeguarded even if an employee leaves the current company and starts working elsewhere. Here, there is some internal leakage of information. They are two different categories of violations.

Sir,

No confusion, the employees are working with us, but not under my control; they are under someone else. The same employee has leaked confidential information, which needs to be addressed. He came near my cabin, overheard the discussion, and divulged the details to the person he reports to.

This issue has also been raised by my chairman. Now, what action should be taken against the person responsible for leaking information under someone else's control?

Basically, the case is of an employee overhearing some discussion and leaking it out. You will have to conduct an inquiry to gather evidence, and only then can action be taken. There is no issue of nondisclosure here.
