Dear all,
we are a manufacturing company and union of workers is also there. A worker remains absent perpetually and in his applications gives false reasons. For that matter we sent our representative to his home just know the fact whether the reasons were actual or not. Union took it wrongly and opposing saying that employer can not send any person to worker's home and it is against law. We all know that it is part of Industrial Relation to know worker's problem and ethically it is right.
But my question is: Is there any rule where we can send our representative to worker's home?

Rather than sending company representative to the worker's home, you may run counselling centre for the workers and their families. This helps in understanding their personal problems.
Sending someone from the company to the home, unless the worker is suffering due to dire sickness or because of some other problem, could be considered as nosiness by the labour union. HR representatives visit hospital or even homes during the sickness or accidents.
Secondly, is visiting worker's home a regular feature? If yes, then do you have records as to who made such visit, when it was made and why it was made. With the records at hand, you could have told that such visits are part of the employee welfare/counselling activities.
Anyway, you may learn from this instance about visits to the workers' homes.

Do your employee and workmen resides in company colony or at own arrangement. If in company colony the team led by welfare officer or any team formed for colony management can go but with an intimation to workmen/employee, at least with a lady staff as companion.
In the matter of absentism, hold employee counselling involving union representative and HOD as well. You can also discuss the issue in works committe meeting.
You can take the help of Central Board of Workers Education an autonomus body works for awreness building among workmen & family counselling. You contact the local offfice of the CBWE for such intitiative and it's result is good, the main advantages is that things we can not speak from your mouth can be spelt out from their mouth.
If you still feel not satisfied, workman can be asked for explanation for un called absentism refering the clause of Stading Order.

As suggested by seniors here you need follow appropriate methods for doing such visit or take up counseling activities.
Beyond that Union representatives (it may be, as you are stating the employee is a chronic absentee) times tend to protect the employees,they might want your attention to be diverted by raising unnecessary queries on the act you have resorted to.

As Mr.Vinayak said a HR representative of the company you should develop a strategy of visiting the residences of employees occasionally so that this type of situation won't arises and Union don't have any right to stop you / create issue on such visits. Some times you need to bulldoze failing which the Union office bearers will take advantage and create nuisance. You can also think of deputing his/ her superior to make house visits so that there won't be much issue on that. It is very clear that the employee is well and you will get the reliaty once you visit the house hence union is try to make an issue on the same.
You should take a tough stand and go ahead failing which the Union will be creating an issue on all the initiatives of the management and don't allow you to proceed.

In our organization we have been visiting absentee family to counsel them and also appraise them about the consequences of habitual absenteism. Even we have pasted show cause notice on the doors of the absentees residence. It has yielded fruits. We also appraise all these to the union rep as they appreciate our efforts.
