My question is if i required to construction my new building. I hire a contractor for the complete construction of my building, he hire labour for the construction work. so that is it necessary for deduct PF of labour or not. But he deduct ESIC.

Dear Ravi, Please Clarify whether your Establishment is already covered under EPF Act? what is this New Building? are you engaging contract Labour in connection with work of your Establishment? Before awarding Contract to your Contractor you have to specify the Statutory Compliance required from Contractor

This is my new organization so till present i didn't take EPF registration.
New building will be use in future Manufacture unit.

Dear Mr Ravi, From your Reply it is confirmed that you have engaged Contractor to Construct a Building.Please furnish details of Contractor-Whether he is covered under EPF/ESI Act.If he is covered under the relevant acts, he has to comply with same.While awarding Labour Contract, you as principal Employer have to verify Labour Contractor Statutory Registration/Compliance

You are a Principal Employer of a construction site. You are a developer or builder. You are in to business.
If you are employing more than 20 persons including contract labours then you have to register with EPFO and comply accordingly.
If you are employing more than 10 persons including contract labours then you have to register with ESIC and comply accordingly.
Even you have single employee, you need to obtain PT number and comply accordingly.
Even you have single employee, you need to obtain MP Labour Welfare Fund number and comply accordingly.
If you are executing any work in any place with the help of 20 or more contract labours, then you have to obtain registration under CLRA and your contractor is require to obtain licence if he employs 20 or more labours in that particular place.
If you employ 10 or more construction workers at any place, you need to register such place under BOCW Act. You also require to register your construction workers as beneficiaries under BOCW Act and pay cess at 1% of construction cost.
