Need some clarity on notice period buyout. As per the appointment, it's mentioned we can either serve 90 days of NP or buyout. But the concern is now the head of the department is refusing to relieve and instead asking to serve the full 90 days of the notice period.

The resource got an offer and accepted to join the new organization within 45 days, thinking he can buy out the notice period. But in the current organization, they seem to be threatening. Can someone please help with a suggestion?

If there is a specific stipulation that the employee can resort to a buyout instead of serving the entire notice period, the employer cannot simply reject it unless there are unavoidable/extenuating circumstances like the pendency of a time-bound assignment in which the employee has an important role that cannot be substituted.
