Hi all,

I am working in a private limited company as an HR manager, and the company management has not paid my salary for 7 months. I tried to complain to the Chief Labour Commissioner (Central), but the Labour inspector said I do not fulfill the workman definition, so they are unable to register my complaint.

Please suggest what I should do.

I think that as an HR Manager, your monthly gross salary would exceed Rs. 24,000. Therefore, you cannot seek any remedy under the Industrial Disputes Act, 1947 as a worker or under the Payment of Wages Act, 1936. If you are not concerned about your continued employment with the company, you have the option to file a Civil Suit against the management for breach of contract, recovery of pending salary, and damages. This, in my opinion, is the only recourse available to a managerial employee in such a situation.

Can the complainant represent himself in the labour court without a lawyer? Is there a court process for this. Please advise.
