I have worked in a company for 5 1/2 years and submitted my resignation through email to the CEO. In our company, it is a formality that they do not pay the last month's salary. The CEO orally informed me that he is not accepting the resignation and not willing to give a relieving letter. Is there any way to collect my last month's salary? Till now, I have not applied for Gratuity. Can you guide me, please.

The formality of not paying last month's salary is irregular. Or is it paid only with F&F? If your resignation is not accepted, then how will you get gratuity? What is the policy for exit from your company as per the appointment order?

Thanks for the information. I would like to inform you that there is no specific HR policy in our company. In the appointment letter given to me in the year 2012, they also did not mention the notice period. May I know what F&F?

Based on the documents and the evidence, I feel you can establish that you have been in employment for more than five years. You can then file a petition before the Payment of Gratuity Authority to claim Gratuity. Upon your resignation, please reconfirm by sending a copy via registered post to the CEO. Additionally, it is advisable to submit an application before the Payment of Wages Authority for one month's salary and a relieving letter.

If I proceed to file a petition with the Payment of Gratuity Authority and my company states that it is completely in loss and not able to pay the gratuity, then what course of action would I have to take.

Sending the reconfirm letter through Registered Post is okay. But in our office, only two persons have been sitting for the last month - one is the CEO and the other is me. The Sales Manager comes, but not frequently. The Finance Manager resigned, the Marketing Manager resigned, and the Office Supervisor resigned. Finally, the office boy has also resigned. If any posts or courier comes, I would have to open it and place the same on the CEO's table.
