1. It depends on whether you are registered under the Factories Act or under the Shops & Establishment (S&E) Act. In the case of the Factories Act, the uniform limit throughout the country for Annual leave with wages is 30 days (same as privilege leave), but the unavailed leave due to organizational exigencies gets carried forward even if this limit is exceeded. The S&E Act is a local Act, and the limit varies from state to state; accordingly, you will have to find out.

2. There is no prescribed lower limit for the ceiling limit of accumulation of leave other than the aforementioned statutory provision.

3. It varies from company to company. Government companies have set a limit of 300 days.

Dear Sir,

In continuation of your response, please note that we are covered under the Shop & Establishment Act. As per the HR manual of the company, the eligibility of paid leave (PL) for an employee during a year is 30 days, which can be accumulated up to 180 days. Any PL beyond 180 days will be encashed or will lapse. Encashment can be done with 42 days of PL as the closing balance. However, we now wish to reduce the maximum limit to, let's say, 90 days. What steps need to be taken to implement this change?

Thank you.
