Dear All,
Hi and a good day.
We have deployed a third-party security agency, but we also want to ensure that it complies with all the required statutory compliances as needed in the social audits conducted by agencies for foreign buyers. Could you please guide us on what precautions and documentation are necessary for the deployment of security guards?
Does this also apply to other contractual services, or are the social compliance requirements the same for other contractual service providers like security or housekeeping services?
Thanks and regards :)

1. Ensure that they do have valid PASARA Licence 2. Ensure that they have exemption under PASARA Act 3. All the security guards engaged needs tobe registered under the Alt.

Dear Prashant ji,
Thank you. Could you please confirm if the PSARA license is sufficient to be shown, or if other documents will also be required for social audit purposes? I need a list of documents that we may ask to be maintained at our site for the same purpose (auditing).

Hi All,
Thank you for the PSARA information. It is currently unclear whether the Shop and Establishment Act or the Factory Act will apply to the security agency that is acting as a service provider for us. The security agency is a service provider, and we are a manufacturing company. Similarly, on what basis should all the statutory documents be maintained?
Another question arises: if such a security agency is headquartered in Delhi and is providing services in Gurgaon, which state's rules will apply?
Thank you.

Above is in context to a manufacturing company that requires statutory documents to furnish. So, what documents does this manufacturing company need to submit, and what will be the working hours basis (shop floor or factory act) to be taken and shown by the factory for the third-party security personnel.
