Not eligible for gratuity as the relevant section of the Payment of Gratuity Act states that a minimum of 5 years of continuous service is required to be eligible. This requirement has been revised to 4 years and 240 days by the courts.

If an employee worked 4 years and 8 months then he will be eligible for Gratuity. in this case, he will not eligible as he worked only for 4yrs 7 months....
