Dear members, Please guide me.
I am 4 month pregnant and associated with recruitment consulting company from past 2 years ,the day i told them i am pregnant thing have changed for me they have stopped giving me work and i had few complication in 3rd month of pregnancy and took work from home and was continuously working in spite of all those effort once i am back to office i got to know that they have decided me to remove me from project, i told them I am absolutely fine and ok to take up work but they are denying and asking me to resign.
They are making thing difficult for me every day directly and in directly saying you can take rest and resign and you can come and join us after everything is done.
firstly they were saying you will have stress hence better you resign and take rest but when i said i will not resign they are saying we dont' have project hence we cannot accommodate you. and everyday they are threatening me you are non performing we can sack you i am asking them to give me work or project but they are not responding.
Please look in to matter and help me. These private company have legal team and we as individuals at time feel very helpless to fight against them also in cases like pregnancy family also asks to leave and avoid such tension but ultimately its very demotivating as our govt is trying a lot for women empowerment and on other side companies like these are making pregnant ladies target and playing ruthlessly with their career and health.

Dear Palak,
It is really sad to hear, but yes you can approach nearest labour office to complain for the same and meet your area's labour officer to assist you on this issue. Also, now a days there are many electronic complaint gateways are available on which you can try to post your complaint.

You have not mentioned any details about your role and designation, please mention those details.If you have any compulsion to work then take a long leave on the basis of medical report and opinion and joined back after the situation is under your control.
Since the maternity benefit Act has been amended many employers are playing truant, but, they can not force you to resign. They will create situations for you to resign, do not succumb to the bully & apply for leave on document with acknowledgement and if they refuse to accept, send it by Registered A/D.
But clear opinion can only be given after you provide desired inputs.

Currently i am working as a recruiter , they are saying company is not doing good and my role has become reduntant they are trying to get me some role. also asked me to sit in ofc which is almst 12 Km from my house.
during 3rd month of my pregency i was sick due to morning sickness although i was operating from home, but they are not ready to consider that and deducted leave hence i dont have any leave balance left.
I can clearly sense they are planning to build a case against me so that they can terminate me on performance or role redendency ground as i have clearly told them i wount resign. . in month of june before declaring my pregency they gave given me top performer award, and just after telling them they are play this cheap tatics with me to make my life miserable
please suggest can they terminate me by saying my performnace is not up to mark or they have no role left for me.

I would suggest that you take leave on medical grounds if you wish to smoothly save your job.

Dear Palak,
Have you shared the information with the company, through a formal mail or an application? If no, immediately do so. Also, do not resign, you can take holiday on the Maternity Benefit Act.
Having a legal team, does not mean they can bend the laws. Also, they might be genuinely wanting to shift you some other project, as you will surly go on a 6 months leave and no project can be kept un manned till that date. Take the smaller project, which may be for the time, you will be working before the Maternity Leave.
Keep the correspondence in writing and on mail, with a CC to the HR and the Top Management along with your group or team leader.
