I am a Sr. Citizen and in great distress. I worked in a proprietors organisation who appointed me as a Technical Consultant and I signed an unregistered contract for serving 2 years. However, even the status was of Consultant as per contract, I worked as any regular employee, signed attendance register, submitted leave application in employer's prescribed format, did abide by all verbal and written instructions by proprietor like all other employees on pay roll. My signature was officially sent to many Govt agencies/instrumentalities authorising to sign various documents on behalf of the company.

I served this proprietors organisation for more than one year and then abiding by the contract, tendered one month's notice and left the services on completion of notice period. I handed over the charge by way of a handover /take over note duly signed by me and the Sr. Manager in-charge of the department to which I was attached. Now I need your valuable legal advice in the following matters :

1) All other employees get 28 days leave per annum. But even I mentioned in my resignation letter, unavailed leave was not paid to me as encashment.

2) All employees received Bonus on last diwali except me. I claimed bonus for the period of service (1+ year) I rendered to my employer. But it was not paid.

3) My final dues were not settled on my last working day but paid after 10 days.

I need to know if considering all the above, am I legally eligible for payment of bonus and encashment of leave not availed by me.

Kindly advise my further course of actions .
