What is your opinion if any person suffer from cancer and case is ongoing in industrial court since last eight years. He/She won the case in labour court.
My question is after his/her death the case will be closed or not?
Anybody his/her wife/husband/son can continue fight the case in court. I hope you will reply.

For getting an appropriate reply you need to be specific about the issue. Till the time we don't know what was the case all about till then we were not been able to give you proper reply on it.

You have mentioned that in the Labour Court/Industrial Tribunal proceedings are going on from the past 8 Years.You have also mentioned that verdict in the Labour Court is in favour of Employee.Where is the question of Case will be closed or not? Since the verdict is in favour of Employee, The question of Legal heirs contesting the matter does not arise. are you an Employer? or Deceased Employee legal heir?

The pending industrial dispute initiated by a workman before any forum under the Industrial Disputes Act,1947 does not get abated by his death and his legal heirs can continue it; only the relief sought for would be different. Even if the workman dies after an award in his favour, still the legal heirs can claim monetary compensation, if any payable out of the award.
