Maternity leave increases to 26 weeks from the current 12 weeks as per the Maternity Benefit Amendment Bill passed in the Lok Sabha.

Hi,

This is good news for new mothers, but I want to ask one question: If an employee is on maternity leave from January 1, 2017, and according to the old maternity leave rule, her leave is supposed to end on March 31, 2017, does the amendment in the maternity leave rule apply to her? Can she avail the benefits of the 14 weeks extended leave?

Amendments have not become law as of today. Once it becomes law, from that day onwards, an employee is eligible for 26 weeks of benefits, including 8 weeks of prenatal and 18 weeks of postnatal leave. If an employee is already on maternity leave as per the earlier law on that date, she will be eligible for the remaining 26 weeks.

Thanks for the guidance can you please suggest me one thing that in what time a bill become law and come into enforcement because if this act is delayed then I have to leave job.

Once the President gives his assent to the bill and from the date of publication in the gazette or the effective date mentioned in the gazette.
