Hello everyone. I need help. Let me start from the beginning. Actually, I had met with an accident in October, so I was at home for 1 month on bed rest from October 22 to November 14. My company was not ready to pay. After asking many times, they only gave half of October's salary and half of November's, but they did not give the full month's salary for December. In January, when I asked for my salary, they told me not to come into the office from tomorrow without any reason, and they terminated me. They are not even willing to provide my experience letter despite my repeated emails and continuous phone calls. What should I do?

See consider the following points:
1) You are not covered under the Payment of Wages Act as the salary is greater than 18,000.
2) You did not get hurt at work, and your employment is not hazardous.
3) There is no ESI as the salary is greater than 15,000 (now it is 21,000).
4) You are entitled to December salary under the Shops and Establishment Act. Kindly go to the area labor inspector and lodge a complaint against the company. Show the company email. You can challenge your termination if you wish. But you did not submit any medical documents either. It is your responsibility to submit medical documents to your employer while applying for leave.
Regarding your outstanding wages, you may approach the referee under the Shops & Establishment Act if your company is covered under the Act. However, I am sure the company is going to use the non-submission of medical documents as a reason for the deduction of salary.

How does the accident relate to your employment? You were in your hometown at the time of the accident.
What is the reason they have not paid your salary after you rejoined? It's unlikely that they will just stop for the fun of it.
Why do you expect full salary for October and November when you were not at work in those months?

Main ek authorized Samsung service center mein floor manager ke roop mein kaam kar raha hoon. Yahan 18 employees kaam karte hain, jinhe na to koi joining letter mila hai aur na hi koi PF ki suvidha hai. Ek baar PF ke liye form bhara gaya tha, lekin uska kuch nahi hua. Ye baat ek saal pehle ki hai. Pehle office timings 10 baje se 7 baje tak thi, lekin aaj office timings 9 baje se 8 baje tak ho gayi hain, par salary wahi hai. Iska koi legal record nahi hai. Service center malik jab chahe kisi bhi notice ke bina kisi ko nikal deta hai, aur gaaliyan dena aam baat hai.
Mujhe sirf ye janna hai ki inke khilaf kuch legal action liya ja sakta hai jisse saare workers ko accha mahol aur suvidhayen mil sake. Kya mere 8 saal ek hi firm mein kaam karne ke mujhe koi benefit mil sakta hai? Meri mummy cancer patient hain, is wajah se pichle ek saal se meri chhuttiyan kuch jyada hui hain. Kabhi-kabhi office mein bina bataye timings thik nahi rahi, is wajah se wo mujhe bhi nikal rahe hain. Kya yeh sahi hai? Mera koi adhikar nahi hai, mere 8 saal bekaar gaye...
