A Workman has been transferred from his place to another State after 18 years of service. the workman has challenged his transfer as malafide through labour tribunal. Now employers have neither terminared nor suspended this workman and stopped his salary from the month of transfer. How to overcome this situation to get his salary/reinstatement.

from employer point of view,
the employer is absent as the transfer has been initiated, and the employee has not reported on the workplace.
SCN for absent 3 times, on notice board also, and thereafter "no trace", strike off the name from pay roll

Does the appoint order has transfer clause? and if so, the employee can not say no. As rightly indicated by Mr Sharma follow the same. Srinivasan
