Hi,

I have been working in a company for more than 2 years, and this company has manipulated my quality performance data. As a result, I am not eligible for any salary hike or growth for the entire year. I have presented evidence of this manipulation to my Team Leader, Senior Group Leader, Manager, and process head. I have followed the company policy that allows any employee to raise concerns with a special department, which is supposed to be fair. Despite raising my concerns through this channel, I have not received a valid resolution. They keep asking for more time, and it has been six months since I started this process, yet I still have not received a satisfactory resolution. Can I file a case against this company in the labor court?

Please help me out.

Dear Satish,

I recommend that you ask for an interview with the Head of HR. If no reply is received, or if he does not take any action, then submit an application to the Managing Director. If the MD also does not take any action, then approach the local labor officer in your area and explain your problem. A single call from the Labor Office will prompt your company officials to act.

At this stage, it is too early to approach the Labor Court. Apart from the admissibility of your case, please note that court cases can drag on for years.

Frankly, I don't think you will have any luck in approaching either the labor court or labor officers. Your company apparently has a grievance resolution system that even you say is fair. They have considered your case and refused to intervene. That means probably they don't believe you or that the system is not as fair as you think it is. Or there are other things you are not telling us. For example, why would anyone manipulate your performance and quality data? For what reason or benefit?

You can't fight the employer. If you are as good as you say you are, just find another job and walk off. Why bother to stick to a job where your skills and contributions are not appreciated.
